Data Facts Privacy Policy

Data Facts, Inc. (“Data Facts”) is a consumer reporting agency that prepares consumer reports for authorized users under the provisions of the federal Fair Credit Reporting Act (“FCRA”) and other applicable state and federal laws. Protecting your privacy is important to Data Facts. The following policy details the safekeeping and confidentiality measures Data Facts takes to protect client and consumer nonpublic personal or financial information.

This Privacy Policy covers Data Facts’ website, Data Facts’ practices for handling personal information provided to Data Facts by the general public using Data Facts’ publicly available web site, and personal information provided by Data Facts’ clients, their job applicants, employees, and others who have given their written authorization for Data Facts’ clients to conduct a background investigation on them. The Privacy Policy describes the information that Data Facts. collects about you; how we use and protect this information; and the choices you can make about how we use this information. Data Facts respects the privacy of our visitors and clients. It is our policy to maintain the confidentiality and privacy of any personal data voluntarily submitted to us in the course of business or while visiting our website. We will use the information obtained from our visitors, our clients, and their job applicants for internal purposes only, so that we may produce consumer reports, respond to your inquiries in a complete and timely manner, and provide regular updates on new products and services available from our company. Data Facts will collect and use personally identifiable information only in compliance with applicable law. We will not sell, rent, or share your information in a manner that does not comply with this Privacy Policy.

Information Covered by This Policy

This Privacy Policy applies to information, including personal information, collected about you by Data Facts. Personal information is information, or a combination of pieces of information that could reasonably allow you to be identified. Some of our website pages may contain links to non-Data Facts sites. We are not responsible for the privacy policies of those sites. We recommend you review the privacy policies of each site you visit.

Access

In compliance with the FCRA, a consumer may request access to all data collected and maintained about the consumer in the Consumer Report. This allows the consumer the reasonable opportunity to ascertain what personal information Data Facts possesses about a consumer, and to correct, amend or delete information that is inaccurate or incomplete. Disclosure is provided under the terms of the FCRA. Under certain circumstances, a consumer is entitled to a free copy of their report. Under all circumstances, a consumer is entitled to a copy of their report under the terms of the FCRA.  For those consumers who are not citizens of the United States, we reserve the right to charge an administrative fee not to exceed $15 to cover the cost of reviewing our records to determine if a consumer is in our file, and the administrative cost of obtaining and forwarding any information. Data Facts reserves the right to engage in reasonable efforts to confirm the identity of the individual requesting the report, so that we only provide the report to the consumer that is the subject of the report.  Although we make every effort to ensure that the data we collect and report about you is as accurate as possible, Data Facts cannot guarantee that third parties are committed to making the same efforts, and therefore we are not responsible for the accuracy of the data they provide. 

Security

Data Facts is committed to protecting the personal information that we receive about consumers. We utilize a combination of online and offline security technologies, procedures, and organizational measures to help safeguard consumer information against loss, misuse, and unauthorized access, disclosure, alteration, and destruction.

We use Transport Layer Security 1.2 or 1.3 (TLS) data encryption when data is transmitted over the Internet to our website. We have installed layered firewalls and other security technologies to help prevent unauthorized access to our systems. Strong password protection protocols are used on our computers, and employees are kept up to date on our security and privacy policies. Only employees who need the information to perform a specific job are granted access to personally identifiable information. The servers used to store personally identifiable information are maintained in a secure environment, with appropriate security measures. 

Personal information submitted to Data Facts for a background screening investigation may at times be transferred outside of the United States in order to perform the background investigation. All personal information will be transmitted and stored in a secure manner in accordance with the terms of this Privacy Policy.

Children Under Age 13

The Data Facts website and the related Data Facts services are designed to be used solely by companies and individuals for business purposes. Therefore, Data Facts does not anticipate that anyone under the age of 13 will access or use the website or services. Data Facts does not knowingly collect or use personal information from anyone under the age of 13.

Collection and Use of Information

Information we collect:

We may collect information about you from a variety of sources, including information we collect from you directly, information we collect about you when you visit our sites, use our services, or view our online advertisements, and information we collect about you from other sources (where permitted by law).

Information we collect directly from you:

We collect information directly from you when you choose to register with our site, participate in our offers and programs, purchase products from our site, or otherwise provide information directly to us. The following are examples of information we may collect directly from you:

  • Name, email address, postal address
  • Username and password
  • Phone number or mobile number
  • Future communication preferences

Information we collect when you visit our sites, use our services, or view our online advertisements:

We use cookies and other technologies to collect information about you when you visit our site, use our services, or view online advertisements. The following are examples of information we may collect with these technologies:

  • Site you visited before coming to our site. (We specifically track Google and ways that we are searched.)
  • Data Facts emails you open and/or forward
  • Data Facts offers or links you connect to via emails

How We Use This Information

To provide offers, products, and services. We use the information we collect to provide the products and services you request, to tell you about other products and services offered by Data Facts, and to manage our sites and services.

The following are ways we may use the information we collect about you:

  • Develop new products and services
  • Enroll you in contests, programs, or offers you request
  • To provide you with other services that we have offered to you
  • Create and manage your account
  • Develop and provide advertising tailored to your interests
  • Analyze the use of our products, services and sites
  • Understand how you arrived at our site
  • Determine the effectiveness of our advertising
  • Enforce our Terms and Conditions and otherwise manage our business

How to Opt-In and Opt-Out of Communications

Our website provides you the opportunity to opt-in and opt-out of receiving communications from Data Facts. To have your information removed from the Data Facts’ database, please contact us with your request online, as follows:

Click “Email Preferences.” Each email that we send you contains an “email preferences” link at the bottom of the email. Open your email, click the link for email preferences (located in the footer) and follow the instructions on the screen to manage your communication preferences.

Click “Unsubscribe.” Each email we send you contains an “UNSUBSCRIBE” link at the bottom of the email. Open your email, click “UNSUBSCRIBE TO ALL FUTURE EMAILS” and you will be opted out of all future communications (including all support updates). For our customers, we highly recommended that you update your email preferences (as stated in the above paragraph) versus doing a complete opt out.

Cookies, Web Beacons, and other Technologies

Cookies. A cookie is a small file placed on your computer when you visit a site that can be understood by the site that issued the cookie. We use cookies to monitor how our site is used and to help personalize your online experience. For example, when you register on our site, we may store a unique code in a cookie on your computer. The next time you come back to the site from that computer, our servers use the cookie to recognize you. We can then use the information you provided when you registered combined with your activities on our site to provide you advertising and offers of interest. You can accept or decline cookies. Most browsers automatically accept cookies. We do not store any personal information about you in the cookie.

Third-Party Advertising. We may allow third parties, including business partners and ad networks, to display advertising on our sites. Some of these companies may place a cookie on your computer to recognize your computer each time they send you an online advertisement. This enables them to understand where you, or others who are using your computer, saw their advertisement and deliver ads that they believe are of interest to you. We do not control these companies' use of cookies.

Web Beacons. Web beacons are small bits of code embedded in web pages or in emails. We may use web beacons to deliver or communicate with cookies, to count users who have visited a web page, and to understand usage patterns. We also may include web beacons in emails to learn if messages have been opened, acted on, or forwarded. You can disable the ability of web beacons to capture information by declining cookies.

Other Technologies. Examples of other technologies we may use to provide better service to you include:

  • Web Session Variables. Information that is passed from one web URL to another as you browse.
  • Browser plug-ins/add-ons. Additional web components that may need to be installed to enable certain web features on our sites. You have the option not to install these components.

California Consumer Privacy Act

CALIFORNIA CONSUMER PRIVACY ACT STATEMENT: Under the California Consumer Privacy Act (“CCPA”), California residents have certain rights, effective January 1, 2020, regarding their personal information. However, the CCPA, including these CCPA rights, does not apply to activities conducted by a consumer reporting agency subject to the FCRA. (See Cal. Civ. Code §1798.145(d)(1). Importantly, Data Facts is a consumer reporting agency that handles the personal information of California residents only subject to the FCRA. Consequently, CCPA rights do not apply to the personal information of California residents that Data Facts collects and maintains for purposes of providing its services as a consumer reporting agency. Data Facts will handle the personal information of California residents only as authorized by the FCRA. California residents may exercise their rights under the FCRA by contacting Data Facts at: compliance@datafacts.com.

Information Security

We are committed to keeping personal information secure. We have appropriate technical, administrative, and physical procedures in place to protect personal information from loss, misuse, or alteration. We limit access to personal information to those who have a business need. We keep personal information only for a reasonably needed amount of time. When we provide your personal information to our third-party service providers, we require those companies to protect the information and to not use the information for any other purpose.

Changes to This Privacy Policy

We will post changes to this Privacy Policy and update the effective date when this Privacy Policy is updated. The changes will take effect as soon as posted. We encourage you to review this Privacy Policy periodically.
