OSHA defines workplace violence as any act or threat of physical violence, harassment, intimidation, or other threatening disruptive behavior that occurs at the work site. Homicide is currently the fourth-leading cause of fatal occupational injuries in the United States. According to the Bureau of Labor Statistics Census of Fatal Occupational Injuries (CFOI), of the 4,547 fatal workplace injuries that occurred in the United States in 2010, 506 were workplace homicides. EEOC Guidance Criticized During House Panel Meeting

Panelists testified before a House subcommitte panel on Tuesday, calling The Equal Employment Opportunity Commission’s (EEOC) 2012 guidance on an employer’s use of criminal background checks an example of administrative overreach

 Rep. Tim Walberg, Chairman of the House Subcommittee on Workforce Protections, said the EEOC’s guidance is “flawed” and criticized the agency for denying the public the opportunity to comment on the guidance before it was issued two years ago.
