Data Facts Privacy Policy
Data Facts, Inc. (“Data Facts”) is a consumer reporting agency that prepares consumer reports for authorized End-Users under the provisions of the federal Fair Credit Reporting Act (“FCRA”) and other applicable state and federal laws. These consumer reports may include employment screening, background checks, credit reports, tenant screening, occupational health screening and reports, and other data.
Protecting your privacy is important to Data Facts. The following policy details the safekeeping and confidentiality measures Data Facts takes to protect client and consumer nonpublic personal or financial information.
This Privacy Policy covers Data Facts’ website, Data Facts’ practices for handling personal information provided to Data Facts through the use of Data Facts’ publicly available web site, and personal information provided by Data Facts’ clients, their job applicants, employees, and others who have given their written authorization for Data Facts’ clients to conduct a background investigation on them. The Privacy Policy describes the information that Data Facts collects about you, how we use and protect this information, and the choices you can make about how we use this information. Data Facts respects the privacy of our visitors and clients. It is our policy to maintain the confidentiality and privacy of any personal data voluntarily submitted to us in the course of business or while visiting our website. We will use the information obtained from our visitors, our clients, and their job applicants for internal purposes only, so that we may produce consumer reports, respond to your inquiries in a complete and timely manner, and provide regular updates on new products and services available from our company. Data Facts will only collect and use personally identifiable information in compliance with applicable law. We will not sell, rent, or share your information in a manner that does not comply with this Privacy Policy.
The use of Data Facts’ website and services indicates your agreement with Data Facts’ privacy policy. This policy will be modified from time to time. Please check the privacy policy each time you use our website for the most current information.
Information Covered by This Policy
This Privacy Policy applies to information, including personal information, collected about you by Data Facts. Personal information is information, or a combination of pieces of information that could reasonably allow you to be identified. Some of our website pages may contain links to non-Data Facts sites. We are not responsible for the privacy policies of those sites. We recommend you review the privacy policies of each site you visit.
Access
In compliance with the FCRA, a consumer may request access to all data collected and maintained about the consumer in a Consumer Report. This allows the consumer the reasonable opportunity to ascertain what personal information Data Facts possesses about the consumer, and to correct, amend or delete information that is inaccurate or incomplete. Disclosure is provided under the terms of the FCRA. Under certain circumstances, a consumer is entitled to a free copy of their report. Under all circumstances, a consumer is entitled to a copy of their report under the terms of the FCRA. For those consumers who are not citizens of the United States, we reserve the right to charge an administrative fee not to exceed $15 to cover the cost of reviewing our records to determine if a consumer is in our file, and the administrative cost of obtaining and forwarding any information. Data Facts reserves the right to engage in reasonable efforts to confirm the identity of the individual requesting the report, so that we only provide the report to the consumer that is the subject of the report. Although we make every effort to ensure that the data we collect and report about you is as accurate as possible, Data Facts cannot guarantee that third parties are committed to making the same efforts, and therefore we are not responsible for the accuracy of the data they provide.
Security
Data Facts is committed to protecting the personal information that we receive about consumers. We utilize a combination of online and offline security technologies, procedures, and organizational measures to help safeguard consumer information against loss, misuse, and unauthorized access, disclosure, alteration, and destruction.
We maintain physical, electronic, and procedural safeguards to guard the personal information you provide to us. Our products and/or services online are transmitted through a Transport Layer Security 1.2 or 1.3 (TLS) data encryption when data is transmitted over the Internet to our website.
Furthermore, we have security protocols and measures in place to protect the personal information we maintain about you from unauthorized access or alteration. These measures include internal and external firewalls, physical and technological security measures, and encryption of certain information (including login credentials). Strong password protection protocols are used on our computers, and employees are kept up to date on our security and privacy policies. Only employees who need the information to perform a specific job are granted access to personally identifiable information. The software used to store personally identifiable information are maintained in a secure environment, with appropriate security measures.

Personal information submitted to Data Facts for a background screening investigation may at times be transferred outside of the United States in order to perform the background investigation. All personal information will be transmitted and stored in a secure manner in accordance with the terms of this Privacy Policy.
Children Under Age 13
The Data Facts website and the related Data Facts services are designed to be used solely by companies and individuals for business purposes. Therefore, Data Facts does not anticipate that anyone under the age of 13 will access or use the website or services. Data Facts does not knowingly collect or use personal information from anyone under the age of 13.
Collection and Use of Information
We may collect information about you from a variety of sources, including information we collect from you directly, information we collect about you when you visit our sites, use our services, or view our online advertisements, and information we collect about you from other sources (where permitted by law).
Website Users. When you visit this website, we provide you with the opportunity to opt out of data collection efforts including general internet data, such as your internet protocol address, your location, the web page from which you entered our website, which of our web pages you visited, how long you spend on each page, and other behavior while visiting our websites and third-party links. Unless you opt out, we collect this information with a tool called a “cookie”. It will be saved on your computer. Customer/Vendor. Customers are organizations that contract with us to procure consumer reports and utilize our services (“customer” or “client”). They may also be referred to as the End-User of the consumer report.
Vendors, consultants, or other service providers are those individuals or organizations that Data Facts contracts with to provide certain services to Data Facts, perform certain business-related functions or provide certain data.
Type of information collected includes contact information such as name, email address, phone number, address, or other contact information necessary to provide the services, commercial business information such as payment and billing information, contacts, banking or credit card information, account numbers, email addresses and payment or financial information, and organizational information such as the products you order, your company information, size, credit information, and other non-personal information.
Candidate or Data Subject of our Client. A candidate or data subject is an individual for whom one of Data Facts’ clients has requested Data Facts to procure and prepare a consumer report.
In addition to information collected as a website user, Data Facts may collect the following regarding data subjects/candidates:
- Contact information including name (including prior names and AKAs), email address, address, phone number, and location
- Identifying Information including social security or other government identification number, driver’s license number, date of birth, or other identifying information necessary to determine your identity and provide accurate background screening reports
- Address history
- Criminal record history and information, police records, arrest records, and/or convictions.
- Driving history
- Credit history information, including credit(s), debits, judgments, payment history or patterns, or other credit characteristics
- Education history and information
- Employment history and information
- Professional licenses
- Right to work information
- Occupational health and drug test screening results
- Opinions and references
- Directorship and corporate governance, corporate affiliations
- Publicly available media (social, print or online)
- Other information that may requested by the client
Prospective Data Facts Employees. Data Facts may collect the same information we collect from our clients’ candidates or data subjects in order to evaluate your eligibility as an employee and/or to perform a background check. In addition to the data subject information, you may provide other information to us during an interview which you feel is necessary for Data Facts to know.
Current Data Facts Employees. In addition to the foregoing information collected during your application process, Data Facts will collect the following information:
- Interests and other personal information you’re willing share with us
- Professional background information
- Identity information including date of birth, identity documents, nationality, citizenship, immigration information or other identifying information to ensure you are authorized to work in the location you are being placed.
- Diversity information or other information including sex, gender, ethnicity, disability information, veteran status, race or other information. This information is for statistical purposes and will not be connected to your identifying information.
- Your work history, progress, job performance, productivity and other information that can help manage your work product
- Your tax and payroll information, financial information, benefits, insurance information, medical information if needed to provide benefits, and other personal characteristics
Information we collect directly from you. We collect information directly from you when you choose to register with our site, participate in our offers and programs, purchase products from our site, or otherwise provide information directly to us. The following are examples of information we may collect directly from you:
- Name, email address, postal address
- Username and password
- Phone number or mobile number
- Future communication preferences
Information we collect when you visit our sites, use our services, or view our online advertisements. We use cookies and other technologies to collect information about you when you visit our site, use our services, or view online advertisements. - Develop new products and services
- Enroll you in contests, programs, or offers you request
- To provide you with other services that we have offered to you

- Develop and provide advertising tailored to your interests

How Does Data Facts Store Your Personal Information and Data?
How long we keep personal information depends on the type of information and the purposes for which it is collected. We retain personal information (i) as long as it is needed to provide our services, (ii) long enough to meet our and our clients’ contractual, legal, and business needs, or (iii) as long as we have an ongoing legitimate business or legal purpose to do so. Once we no longer need your personal information, it is deleted or anonymized, meaning you can no longer be identified from any remaining information.
What Are Your Data Protection Rights?
You have certain data protection rights under various privacy laws. You are entitled to the following rights:
- The right to access – You have the right to request that Data Facts provide copies of your personal data. We may charge you a small fee for this service.
- The right to rectification – You have the right to request that Data Facts correct any information you believe is inaccurate. You also have the right to request that Data Facts complete information you believe is incomplete.
- The right to erasure – You have the right to request that Data Facts erase your personal data, under certain conditions.
- The right to restrict processing – You have the right to request that Data Facts restrict the processing of your personal data under certain conditions.
- The right to object to processing – You have the right to object to Data Facts’ processing of your personal data, under certain conditions.
- The right to data portability – You have the right to request that Data Facts transfer the data that we have collected to another organization, or directly to you, under certain conditions.
Access to Data Controlled by Our Clients
In some cases, Data Facts processes personal information on behalf of our clients. If you are seeking access, correction, or deletion of inaccurate data, you should direct your query to our client (the data controller). If you are a data subject or candidate of one of our clients and would no longer like to be contacted by our clients or wish to withdrawal your consent to use our service, please contact the client that you interact with directly.
What Other Important Privacy Information is Applicable?
Accuracy. We understand the importance of accurate data, and we have legal obligations to ensure our screening results are accurate. Most of the personal information collected will come directly from you, so we deem such information accurate. When we collect personal information from other sources, each source is responsible for the accuracy of the information. If we find out your personal information/data is inaccurate we will correct any inaccuracies. To ask for correction of your personal information, contact us.
Disclosure of your Information. In certain situations, Data Facts may disclose information to third parties in response to a legal request. If we are required by a court order, warrant, subpoena, or other enforceable demand to produce personal information we will comply as required by law. Prior to providing any personal information, we will make reasonable efforts, if permitted by law, to notify you and obtain your consent prior to providing such information. If personal information was collected from or on behalf of a client, we will consult with the client if permitted by law.
How to Opt-In and Opt-Out of Communications
Our website provides you the opportunity to opt-in and opt-out of receiving communications from Data Facts. To have your information removed from the Data Facts’ database, please contact us with your request online, as follows:
Click “Email Preferences.” Each email that we send you contains an “email preferences” link at the bottom of the email. Open your email, click the link for email preferences (located in the footer) and follow the instructions on the screen to manage your communication preferences.
Click “Unsubscribe.” Each email we send you contains an “UNSUBSCRIBE” link at the bottom of the email. Open your email, click “UNSUBSCRIBE TO ALL FUTURE EMAILS” and you will be opted out of all future communications (including all support updates). For our customers, we highly recommend that you update your email preferences (as stated in the above paragraph) versus doing a complete opt out.
Cookies, Web Beacons, and other Technologies
Cookies. A cookie is a small file placed on your computer when you visit a site that can be understood by the site that issued the cookie. We use cookies to monitor how our site is used and to help personalize your online experience. For example, when you register on our site, we may store a unique code in a cookie on your computer. The next time you come back to the site from that computer, our website uses the cookie to recognize you. We can then use the information you provided when you registered combined with your activities on our site to provide you with advertising and offers of interest. You can accept or decline cookies. Most browsers automatically accept cookies. We do not store any personal information about you in the cookie.

California Consumer Privacy Act
CALIFORNIA CONSUMER PRIVACY ACT STATEMENT: Under the California Consumer Privacy Act (“CCPA”), California residents have certain rights, effective January 1, 2020, regarding their personal information. However, the CCPA, including these CCPA rights, does not apply to activities conducted by a consumer reporting agency subject to the FCRA. (See Cal. Civ. Code §1798.145(d)(1). Importantly, Data Facts is a consumer reporting agency that handles the personal information of California residents only subject to the FCRA. Consequently, CCPA rights do not apply to the personal information of California residents that Data Facts collects and maintains for purposes of providing its services as a consumer reporting agency. Data Facts will handle the personal information of California residents only as authorized by the FCRA. California residents may exercise their rights under the FCRA by contacting Data Facts at: compliance@datafacts.com.
Information Security
We are committed to keeping personal information secure. We have appropriate technical, administrative, and physical procedures in place to protect personal information from loss, misuse, or alteration. We limit access to personal information to those who have a business need. We keep personal information only for a reasonably needed amount of time. When we provide your personal information to our third-party service providers, we require those companies to protect the information and to not use the information for any other purpose.
Changes to This Privacy Policy
We will post changes to this Privacy Policy and update the effective date when this Privacy Policy is updated. The changes will take effect as soon as posted. We encourage you to review this Privacy Policy periodically.
